New Jersey’s newest lead-based paint law, “New Jersey’s Lead-Safe Certification,” went into effect July 22, 2022 and directly targets ALL pre-1978 rental properties. In addition to new lead paint inspection intervals, New Jersey also requires different testing methods depending on where your rental unit is located. What Landlords Need To Know:
- The new regulation is commonly referred to as the Lead Safe Certification Act.
- New Jersey requires lead paint safe survey for all non-exempt rental units built before 1978, at the next turnover, or by July 22, 2025.
- Landlords must provide evidence of a lead-safe certification to tenants and shall affix a copy of such certification as an exhibit to the tenant’s lease.
- The Lead-Safe Certification will be valid for a three-year period.
- Properties built after 1978 are exempt and some multiple dwellings (3 units or more) may also be exempt. Learn more about exemptions here.
