Be it enacted by the senate and general assembly of the state of new jersey:
- A. Except as provided in subsection b. Of this section, the owner of a business or the owner of a rental unit or units shall maintain liability insurance for negligent acts and omissions in an amount of no less than $500,000 for combined property damage and bodily injury to or death of one or more persons in any one accident or occurrence.
B. The owner of a multifamily home which is four or fewer units, one of which is owner-occupied, shall maintain liability insurance for negligent acts and omissions in an amount of no less than $300,000 for combined property damage and bodily injury to or death of one or more persons in any one accident or occurrence. - This act shall take effect on the 90th day next following enactment and shall apply to policies issued or renewed on or after the effective date of this act.
Statement
This bill requires the owner of a business or the owner of a rental unit or units to maintain liability insurance for negligent acts and omissions in an amount of no less than $500,000 for combined property damage and bodily injury to or death of one or more persons in any one accident or occurrence.
The bill separately requires an owner of a multifamily home which is four or fewer units, one of which is owner-occupied, to maintain liability insurance for negligent acts and omissions in an amount of no less than $300,000 for combined property damage and bodily injury to or death of one or more persons in any one accident or occurrence.
Measure establishing minimum insurance requirements released with njaa secured changes
The senate commerce committee considered s-1368 (scutari), which requires all businesses and rental unit owners to maintain at least $500,000 in liability insurance. Based on feedback we received from members in prior sessions, we had secured amendments to ensure that the insurance requirement was building-wide, and not per unit, and that it was combined coverage to account for the variety of ways that liability coverage is provided. Also, under the bill, 1-4 unit owner-occupied properties would be required to maintain $300,000 in coverage. The bill was released by the committee and is on second reading in the senate.
